Michael Wayne Schmidt, 47, died after police say he retrieved a gun as officers tried to take him into custody
A Topeka police shooting Sunday afternoon left a 47-year-old man dead in the 3100 block of SW Chelsea Drive, and the KBI is now investigating.
A 47-year-old Topeka man was killed Sunday afternoon in an exchange of gunfire with Topeka police at a home in the 3100 block of SW Chelsea Drive, and the Kansas Bureau of Investigation has taken over the investigation.
According to a Topeka Police Department news release, two TPD officers went to the home around 4:28 p.m. Sunday, Oct. 4, to investigate a potential violation of a protective order. Police say that after making contact with the man, he ran to a bedroom, and officers followed him.

TPD says the man got hold of a firearm in the bedroom, and one officer repeatedly ordered him to drop it. According to the department, early indications are that both the man and one officer fired their weapons. Medical personnel were called, and the man was pronounced dead at the scene. No officers were injured.
The KBI identified the man as Michael Wayne Schmidt, 47, of Topeka, according to WIBW. The KBI’s account of the Topeka police shooting, as reported by WIBW, adds some detail: officers went to the home to find Schmidt in connection with a previous incident and arrest, Schmidt let them inside, and after a brief conversation, officers tried to take him into custody. Schmidt then went to a back room and retrieved a handgun. The KBI says preliminary information shows Schmidt fired the handgun and one officer fired a duty weapon, and Schmidt was struck. He died at the scene despite EMS response.
At the department’s request, the KBI is leading the investigation into the Topeka police shooting, and per TPD policy, both officers have been placed on administrative leave. TPD Chief of Staff Jamey Haltom spoke with reporters at the scene Sunday night. Police have not released the officers’ names.
TPD says further information will come from the KBI. Once the KBI finishes its investigation of the Topeka police shooting, its findings typically go to the Shawnee County District Attorney, who determines whether the officer’s use of force was legally justified.0……………………………………………
